Welcome to Bharat Taxi, operated by Sahakar Taxi Co-operative Limited ("Co-operative", "Authority", "we", "our", or "us").

These Terms & Conditions ("Terms") govern your access to and use of the Bharat Taxi website ("Website") and the associated mobile applications ("Platform") collectively referred to as the "Services."

By accessing or using our Website, Platform, or related services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please refrain from using the Services.

1. Scope and Applicability

1.1. These Terms apply to:

  • The Website, provides general information, cooperative details, contact facilities, and links to the Mobile Applications; and
  • The Rider Application and Driver Application (collectively Mobile Applications), which facilitate digital tools for members (Driver) and users (Riders) to connect for mobility services.

1.2. The Website is an informational and facilitative portal and may also provide selected self-service booking and payment flows, including access to Bharat Taxi resources and registration interfaces.

1.3. Actual ride-hailing, fare calculation, Driver-Rider matching, etc. occur only within the Mobile Applications, which contain and display the applicable terms and privacy policy.

2. Co-operative Model

2.1. Bharat Taxi operates under the Sahakar Taxi Co-operative Limited, a registered co-operative society functioning under the applicable co-operative societies laws. The Co-operative's objective is to empower its members (i.e. the Drivers) by providing access to digital platforms, technology tools, and administrative support for operating authorised mobility services.

2.2. The Authority acts as a technology facilitator and administrator, and does not itself:

  • own or operate vehicles,
  • employ or contract drivers, or
  • directly provide passenger transport.

2.3. All mobility services are independently rendered by Driver Members, and the Co-operative's role is limited to facilitation and coordination.

3. Legal Status

3.1. These Terms constitute an electronic record under the Information Technology Act, 2000, and rules made thereunder.

3.2. They do not require physical or digital signatures.

3.3. The Authority reserves the right to update or modify these Terms at its discretion, and continued use of the Services constitutes acceptance of such modifications.

4. Nature of Services

4.1. The Platform provides a technology-enabled system that allows Riders to connect with independent Driver of the co-operative for mobility services.

4.2. The Authority acts solely as facilitators, not as transport operators or employers.

4.3. All rides and transport activities are independent engagements between the Rider and the Driver, governed by applicable transport and motor vehicle laws.

5. Eligibility and Registration

5.1. Website Users

  • Browsing the Website does not require registration. However, features such as enquiry forms, partnership registration, or cooperative onboarding may require basic information such as name, contact number, and email address.
  • Users must provide accurate and complete details and are responsible for maintaining the accuracy of their information.

5.2. Riders

  • Must be 18 years or older and competent to contract under the Indian Contract Act, 1872;
  • Must provide accurate information during registration and booking;
  • Are responsible for maintaining confidentiality of account credentials; and
  • Must use the Platform only for lawful purposes.

5.3. Driver Members

  • Must hold valid driving licence, vehicle registration, insurance, and other regulatory documents;
  • Must provide accurate and verifiable information during onboarding;
  • Must comply with all applicable transport and traffic laws; and
  • If enrolled as a member of the co-operative, shall also comply with the Co-operative's bye-laws and membership policies. In case of any conflict between these Terms and the Co-operative's bye-laws, the bye-laws shall prevail with respect to membership rights, contributions, and governance.

6. User Obligations

6.1. Website Users

Users of the Website shall not:

  • Attempt to gain unauthorised access to the Website, server, or connected systems;
  • Transmit viruses, scripts, or other harmful code;
  • Post or transmit unlawful, defamatory, obscene, or infringing material; or
  • Use the Website for advertising, data scraping, or commercial exploitation.

6.2. Riders

  • Ensure timely payment of fares through authorised payment mechanisms within the App and Website;
  • Not misuse, manipulate, or cancel rides fraudulently;
  • Report any safety, harassment, or lost-property incidents promptly through official channels.

6.3. Driver

  • Operate vehicles in compliance with law and maintain them in roadworthy condition;
  • Not refuse legitimate rides or overcharge beyond applicable fare structures;
  • Treat Riders with courtesy and professionalism;
  • Promptly return any lost property to Riders; and
  • Ensure that their accounts and vehicles are used only by authorised persons.

7. Payments and Fees

7.1. Payment processing may occur through the Bharat Taxi Website and mobile applications, depending on the booking flow and service channel used.

7.2. Fare amounts are determined as per government-notified or co-operatively approved rates.

7.3. The Co-operative may collect service or maintenance contributions from Driver Members to sustain the digital platform, support services, and administrative operations.

7.4. The Co-operative and Authority are not responsible for direct cash transactions between Riders and Driver Members.

8. Intellectual Property

8.1. All intellectual property - including software, design, trademarks, logos, and text - displayed on the Website or Platform is owned by or licensed to the Authority or the Co-operative.

8.2. Users are prohibited from copying, reproducing, or using such materials without prior written consent.

9. Website Content, Accuracy, and Links

9.1. The Website may include general information, announcements, and links to third-party sites for convenience. Such links do not imply endorsement or responsibility by the Authority or co-operative.

9.2. While efforts are made to ensure accuracy, the Authority does not warrant that the content is complete, current, or error-free.

9.3. The Website may use cookies and analytics tools to improve user experience. These are governed by the Bharat Taxi Privacy Policy.

10. Disclaimer of Warranties

The Website and Platform are provided on an "as is" and "as available" basis. The Authority makes no warranties, express or implied, regarding accuracy, reliability, fitness for a particular purpose, or uninterrupted operation. No advice or information obtained through the Website or Platform shall create any warranty not expressly stated herein.

11. Limitation of Liability

11.1. To the fullest extent permitted by law, the Authority and Co-operative shall not be liable for:

  • Indirect, incidental, or consequential damages;
  • Loss of profits, revenue, data, or goodwill; or
  • Disputes, misconduct, or defaults arising between Riders and Driver Members.

11.2. The Co-operative and Authority act solely as facilitators and shall not be held vicariously liable for any independent actions or omissions of individual Driver Members or Riders.

12. Indemnity

Users agree to indemnify and hold harmless the Authority, their officers, employees, and affiliates against any claims, liabilities, losses, or damages arising out of:

  • Violation of these Terms;
  • Misuse of the Website or Platform; or
  • Violation of applicable laws.

13. Data Protection and Privacy

All personal data collected via the Website or Platform will be processed in accordance with the Bharat Taxi Privacy Policy, available at the Website. By using the Services, you consent to such data collection and processing.

14. Suspension and Termination

14.1. The Authority may suspend or terminate access to the Website or Platform if a user:

  • Breaches these Terms or applicable law;
  • Engages in fraudulent, unsafe, or unlawful conduct; or
  • Misuses the Services or brand assets.

14.2. Users may request account deletion at admin@bharattaxiapp.com. Deletion requests will be processed in accordance with the Privacy Policy and applicable law.

15. Dispute Resolution

15.1. For disputes involving Driver Members and the Co-operative, the matter shall first be referred to the Co-operative's internal dispute-resolution or grievance committee (if any) in accordance with its bye-laws.

15.2. If unresolved, or for disputes involving other users, arbitration shall be conducted under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Delhi, India.

15.3. These Terms are governed by the laws of India, and the courts at Delhi shall have exclusive jurisdiction.

16. Miscellaneous

16.1. Force Majeure: The Authority and Co-operative shall not be liable for delay or failure due to circumstances beyond reasonable control.

16.2. Assignment: Users may not assign rights or obligations without prior written consent.

16.3. Severability: If any clause is held invalid, the remaining provisions shall continue in full force.
